Retouret is a brand registered world-wide for watches, straps, and watch components.

When you are using our website www.retouret.ch, Retouret is controlling the data. In this document “we”, “our” or “us” as well as ‘Retouret’ refers to Retouret Watch.

Your access to and use of the Retouret.ch website (the “WEBSITE”) is subject to the following terms and conditions and all applicable laws. By accessing and browsing the Retouret website, you fully accept without limitation or qualifications this Terms of Use Agreement.

PROPERTY RIGHTS

Retouret has the exclusive rights, titles, and interest (unless otherwise stated) to the Website’s Intellectual Property Rights, including but not limited, to its content.

 

Intellectual Property Rights including all intellectual property rights of whatever nature without limitation: all texts, graphics, user and visual interfaces, photos, images, illustrations, trademarks, logos, layout, video clips, audio clips, sound, music, design, know-how, technology, drawing, products, artwork and other materials appearing on the Website, and future rights of copyright, as well as all rights to software programs, code and supporting documentation, moral rights, image rights, patents, trademarks, trade names, goodwill, internet domain names, registered and unregistered design rights, data, database rights and all other intellectual property rights (whether registered or not) or other rights or forms of protection having equivalent or similar effect anywhere in the world, insofar as these rights have been created by Retouret or its employees.

LIMITATIONS OF LIABILITY

You accept that, to the fullest extent permitted by applicable regulations, neither Retouret nor any of its affiliates shall, under any circumstances, be held liable for actual, direct, indirect, special, incidental, or consequential damage, or any other damage, whatever its nature, even if Retouret was previously informed of the possibility of such damage, whether during a contractual action, prejudice or any other possible theory, resulting from, or connected to the use, incapacity to use or execution of information, products or documents on the Retouret Website.

 

All materials downloaded or obtained in any other manner during the use of the Website are at your own risk. Retouret takes no responsibility for any damage or virus that may affect your computer equipment or other property by reason of your access to, use of, or downloading of any material from its Website or for any illegal intrusion or intervention in the IT system.

CHANGE IN TERMS

We may from time to time change the terms that govern your use of our website Retouret.ch. We may change, move or delete portions of, or may add to, our website from time to time. If we make material changes to the Terms, we will notify you through a message posted on the website. Your continued use of our website following any such change constitutes your agreement and affirmative acceptance to follow and be bound by the modified Terms. If you do not agree to, or cannot comply with, the Terms as modified, you must stop using the website.

 

 

ORDERING & PAYMENTS

 

By ordering an item through the Website, you are thereby guaranteeing that the following conditions have been met:

  • You are entitled to enter into legally-binding contracts.

  • You are at least 18 years of age.

Retouret Watch may refuse any order for legitimate reasons; for example, if Reoutret Watch has reason to believe that an order has been placed in breach of these General Terms and Conditions of Sale.

 

You must, during the checkout process, pay the prices of the products you order. Payments may be made by any of the permitted methods specified on our website. If you fail to pay to us any amount due under these terms and conditions in accordance with the provisions of these terms and conditions, then we may withhold the products ordered and/or by written notice to you at any time cancel the contract of sale for the products.

If you make an unjustified credit card, debit card, or other charge-back then you will be liable to pay us, within 7 days following the date of our written request:

  • An amount equal to the amount of the charge-back;

  • All third party expenses incurred by us in relation to the charge-back including charges made by our or your bank or payment processor or card issuer;

  • An administration fee of 30USD plus it may require additional taxes; and

  • All our reasonable costs, losses, and expenses incurred in recovering the amounts including without limitation legal fees and debt collection fees, and for the avoidance of doubt, if you fail to recognize or fail to remember the source of an entry on your card statement or other financial statements, and make a charge-back as a result, this will constitute an unjustified charge-back as stated herewith.

 

Some countries require extra customs/import duties in addition to the price displayed. At the moment of purchase, our Website will indicate whether or not these fees are included in the total amount of your order. Retouret Watch does not provide tax refund slips.

Retouret Watch reserves the right to modify our prices at any time; nevertheless, the price displayed on the Website on the day of the order will always be the only one applicable.

WARRANTY

​

Retouret Watch or the Retailer warrant for two-years from delivery date or in-store collection that the ordered product will be free from defects and fully functional. Retouret Watch shall provide warranty either by

  • repairing the product free of charge,

  • or providing a partial or full replacement with an equivalent product,

  • or giving a price reduction.

 

Any other rights in connection with deficient performance cannot be claimed. This warranty excludes wear and tear as well as damages resulting from third-party handling or from lack of appropriate care.

 

The International warranty is only valid if it has been filled out, dated, and signed by an official approved Retouret Retailer who sold the watch, and who is the sole person authorized for this purpose.

SERVICING & REPARATION

​

In the case of malfunction, goods can be returned for servicing. Goods must be returned in their original packaging. You will be required to ensure the Goods are packaged securely and protected in transit. Shipping costs will be covered by the sender. We do not accept liability for goods that are not returned via the shipping method specified by us. The customer must bear costs for shipping the timepiece to us.

Before sending any timepiece to us, contact us at info@retouret.ch for detailed instructions about how to send us back any timepiece.

 

If you would like to have your watch serviced, please email us to discuss our Service & Repair options. We will get back to you as quickly as possible with the next steps.

SECURITY POLICY

By placing an Order, you agree and understand that we may store, process, and use data collected from your Order for the purposes of processing your Order.

We will use our best endeavor to ensure that such data is kept secure at all times and to protect your personal data from third unauthorized parties. However, you acknowledge that we cannot guarantee and therefore we shall not be in any way responsible for the security or privacy of our Website and any information or personal data provided to or taken from our Website by you. Personal data provided via our Website may be used by us to advise of, offer, and supply goods and services, and for marketing purposes directly relating to us. We do not share your personal data with third parties, except where we reasonably consider it necessary to prevent fraud and to comply with international regulations.

In situations of force majeure, all obligations under these Terms are suspended, provided that after 48 consecutive hours, you may cancel your Account by sending a notice to our Customer Service. If terminated for any of the above reasons, you will no longer be able to access your Account.

These Terms form part of an e-commerce transaction, and the parties agree that these Terms shall be accepted electronically, and the agreement to these Terms is formed and validly entered into electronically.

The termination of these Terms does not affect the parties’ rights in respect of periods before the termination of these Terms.

These Terms and any non-contractual obligation arising therefrom are governed by the laws of the USA and you submit to the exclusive jurisdiction of the courts of Orange, California.
